WASHINGTON — As attention continued to be focused on Healthcare.gov and problems surrounding it, Congress released a draft proposal this week that could be the beginning of the end for Medicare’s sustainable growth rate (SGR) reimbursement formula.
SGR Repeal Bill: 10-Year Pay Freeze, but P4P Incentives
The latest proposal to repeal Medicare’s sustainable growth rate (SGR) formula freezes payment levels through 2023 but creates a performance-based incentive program in 2017, according to a discussion draft released Thursday.
That program — dubbed the “value-based performance (VBP) payment program” — would replace the myriad of current incentive programs for physicians and create a “single budget-neutral incentive payment program,” according to the draft from the Senate Finance and House Ways and Means Committees.
“By combining the current quality incentive programs into one comprehensive program, this proposal would further value-based purchasing within the overall Medicare program while maintaining and improving the efficiency of the underlying structure with which professionals are already familiar,” the draft states.
Most importantly to doctors, the proposal would permanently repeal the SGR.
‘I’m Responsible’ for Website Difficulties, Sebelius Says
Health and Human Services (HHS) Secretary Kathleen Sebelius told lawmakers Wednesday that she is ultimately responsible for the continuing failures of Healthcare.gov, and she accepted the blame for its problems.
Sebelius told the House Energy and Commerce Committee she was as “frustrated and angry as anyone” with the many error messages, crashes, and other bugs and glitches in the website that have prevented consumers from signing up for health coverage under the Affordable Care Act.
“You deserve better. I apologize,” she said at a hearing. “I’m accountable to you for fixing these problems, and I am committed to earning your confidence back by fixing the site.”
Committee Investigates, Subpoenas Healthcare.gov
Six people enrolled in coverage through Healthcare.gov on the first day and 248 did so through two days, the House Oversight and Government Reform Committee said late Thursday, citing HHS meeting notes.
Earlier on Thursday, the committee’s chair, Darrell Issa (R-Calif.), announced he had subpoenaed Sebelius over her failure to provide information they requested over Healthcare.gov’s launch.
On Tuesday, the committee subpoenaed QSSI, a main contractor hired to build the website, after it failed to comply with requests related to its role in the site’s development.
Court Strikes Down ACA’s Birth Control Mandate
A divided federal appeals court struck down on Friday the ACA’s mandate that businesses cover birth control in employees’ health plans.
The D.C. Circuit Court of Appeals said requiring companies to cover employees’ contraception was a violation of company owners’ religious rights. The 2-1 decision marks another defeat for the mandate.
The ACA requires health plans to cover without cost-sharing preventive services, including FDA-approved birth control such as levonorgestrel (Plan B emergency contraceptive). The ACA’s contraceptive mandate took effect Aug. 1, 2012.
FDA Issues Plan to Prevent Drug Shortages
The FDA flexed newly granted regulatory muscle on Thursday in efforts to resolve drug shortages, releasing a strategic plan and a proposed rule.
The strategic plan, mandated by Congress last summer, aims to prevent shortages in the long term by improving the agency’s response to imminent shortages and addressing the underlying causes of them.
The FDA also issued a proposed rule expanding its early notification requirement to biologics and implementing the expanded notification requirements called for under the FDA Safety and Innovation Act (FDASIA), which became law in July 2012.
FDA Seeks to Halt Sale of Leukemia Drug
The FDA on Thursday asked Ariad Pharmaceuticals to suspend marketing and sales of Iclusig (ponatinib), a chemotherapy agent used to treat leukemia, pending further investigation of reports of a link between the drug and increased risk of “life-threatening blood clots and severe narrowing of blood vessels”.
The agency said roughly 24% of patients enrolled in a phase II trial of the drug and 48% of patients in a phase I study “have experienced serious adverse vascular events, including fatal and life-threatening heart attack, stroke, loss of blood flow to the extremities resulting in tissue death, and severe narrowing of blood vessels in the extremities, heart, and brain requiring urgent surgical procedures to restore blood flow.”
The FDA issued a warning about the risk on Oct. 11.
Doc Groups Concerned About Sunshine Act Exemption
A slew of state and national medical societies wrote HHS on Monday to express displeasure with the inclusion of peer-reviewed scientific journals in the reporting mandates for the recently implemented Physician Payments Sunshine Act.
They disagreed with CMS’s conclusion that medical textbooks, reprints of peer-reviewed scientific clinical journal articles, and abstracts of these articles are not directly beneficial to patients or intended for patient use. Under the law, pharmaceutical companies would have to report these as “transfers of value” when given to physicians.
“We believe this conclusion is inconsistent with the statutory language on its face, congressional intent, and the reality of clinical practice where patients benefit directly from improved physician medical knowledge,” the letter stated.
Senate Passes Access to Epinephrine in School Bill
A bill that encourages states increase access to epinephrine in schools is ready to be signed into law after the Senate passed it by unanimous consent Friday.
“This new law will help save children’s lives by encouraging schools to stock emergency epinephrine and by training and authorizing school staff to use it in the event that a student is exposed to an allergen and shows signs of anaphylaxis,” House Democratic Whip Steny Hoyer (D-Md.), who co-authored the bill with Rep. Phil Roe, MD (R-Tenn.), said in a statement.
The bill was endorsed by the American Academy of Allergy, Asthma, and Immunology; the American Medical Association; and the American Academy of Emergency Medicine.

CMS Administrator Marilyn Tavenner will testify before the Senate Health, Education, Labor, and Pensions Committee on Tuesday about Healthcare.gov’s rollout.
The next day, Sebelius will testify before the Senate Finance Committee on the same topic.
The Medicare Payment Advisory Commission will meet Thursday and Friday.
